'Право на права' у теорији грађанства изван суверености

Сажетак
Грађанство и држављанство (мишљени као јединствен појмовни склоп – citizenship)
налазе се у изразито амбивалентном односу према појмовима (и вредностима)
укључења/искључења, права/обесправљености, заједништва и другости. Грађанство
као институција се историјски и појмовно развијало у симбиози с идејама једнакости,
слободе, заштите права и пуноправне припадности политичкој заједници. У том
погледу, његова еманципацијска и просветитељска заоставштина јесте неспорна. Уз
то, критика апстрактности људских права, посебно развијена код Хане Арент,
пружила је основу за додатна савремена тумачења по којима без стабилне политичке
заједнице и њене институције грађанства/држављанства нема ни оквира за заштиту
основних људских слобода и права. С друге стране, за грађанство/држављанство би се
могло тврдити да представља легализовану дискриминацију, будући да a priori
претпоставља као легитимну дистинкцију између грађана и не-грађана. Штавише,
мрежа националних режима држављанства која унапред одређује, у значајној мери,
животне шансе и судбине људи можда оправдано заслужује епитет „кључне полуге у
сегментарној архитектури система нација-држава“ (Brubaker). Овај парадокс
грађанства, његова истовремена еманципаторна и дискриминаторна улога, постаје
посебно изражен у сусрету с феноменима избеглиштва, ирегуларне имиграције и
апатридије. Овај рад проблематизује поменуте тензије и испитује могућности њиховог
превазилажења у оквиру тзв. грађанства изван суверености.
